The following hearing of the International Court of Appeal took place in Paris:

Hearing

Case ICA-2019-08: Appeal brought by the Competitor AF Corse against Decision No. 29 dated 10 November 2019 of the Stewards of the 4 Hours of Shanghai (China), race counting towards the 2019 – 2020 FIA World Endurance Championship

Further to a report from the Technical Delegate, the Stewards of the 4 Hours of Shanghai, by Decision No.29 dated 10 November 2019, decided to disqualify car No. 51 (Competitor AF Corse, Drivers J. Calado/A. Pier Guidi) as it was found that the minimum ground clearance of their car was lower than 50 mm which represents a breach of Article 205 of the WEC Technical Regulations.

On 14 November 2019, AF Corse decided to appeal Decision No. 29 taken by the Stewards during the 4 Hours of Shanghai.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions, decided:

  • To set aside the Contested Decision;
  • To order the competent Sporting Authority to draw, as appropriate, the consequences of this ruling.

The International Court of Appeal was presided over by Mr Michael GRECH (Malta), and included Mr Hervé de LIEDEKERKE (Belgium), Mr Jean LUISI (France) and Mr Nish Kumar SHETTY (Singapore).
